Last Updated: 15 May 2025  ·  Effective: 15 May 2025

1. Definitions

In these Terms and Conditions, the following terms have the meanings given below:

2. Acceptance of Terms

By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

Our services are intended for persons aged 18 and above who have the legal capacity to enter into binding agreements under Malaysian law. By engaging our services, you represent that you meet this requirement.

If you are entering into an engagement on behalf of a business or organisation, you represent that you have the authority to bind that organisation to these terms.

3. Service Description

Wira Bestari provides business consulting and advisory services to small and growing businesses in Malaysia. Our current service offerings are:

The specific scope and deliverables for each engagement are as set out on our website and confirmed in a written engagement summary prior to the start of work. Services are delivered in English and are primarily available to businesses operating in Malaysia.

4. Your Responsibilities

To enable us to deliver an engagement effectively, you agree to:

We rely on the information you provide. Outcomes from an engagement are informed by what is shared with us, and we cannot be responsible for conclusions reached on the basis of incomplete or inaccurate information.

5. Intellectual Property

All content on our website — including text, structure, and design — is the property of Wira Bestari and is protected under applicable intellectual property law.

Written outputs produced in the course of an engagement (session notes, summaries, plans, documentation packs) are provided to you for your own business use. You may share them internally within your organisation. You may not reproduce, sell, or distribute them externally without our written agreement.

Our methodologies, frameworks, and general advisory approaches remain our intellectual property. This does not limit your use of recommendations made in the context of your own business.

6. Payment Terms

Fees for our services are as set out on our website and confirmed in your engagement summary. All fees are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated.

Cancellation and refunds

If you wish to withdraw from an engagement before it has commenced, please contact us. If sessions have not yet begun, a full refund will ordinarily be offered. Once an engagement is underway, refunds will be considered on a case-by-case basis relative to the work completed. We aim to be fair and reasonable in all such situations.

7. Confidentiality

We treat all information shared during an engagement as confidential. We will not disclose client-specific business information to any third party without your consent, except where required by law.

We may use anonymised, non-identifying insights from engagements to inform our general advisory practice. No identifying information will be used or shared without your agreement.

8. Disclaimers

Our advisory services offer considered perspective and structured analysis. They do not constitute legal, financial, accounting, or tax advice. Where such advice is relevant, we will note this and recommend that you consult an appropriately qualified professional.

We do not make representations about specific business outcomes. The usefulness of our advice depends on many factors outside our control, including market conditions, implementation, and business circumstances that may change.

Our website and its content are provided in good faith. We do not warrant that the website will be available without interruption or free from error.

9. Limitation of Liability

To the extent permitted by Malaysian law, our total liability to you in connection with any engagement or use of our website shall not exceed the amount paid for the relevant engagement.

We shall not be liable for indirect, consequential, or incidental losses, including loss of profit, loss of business opportunity, or loss of data, arising from your use of our services or website.

Nothing in these terms limits liability for matters that cannot be excluded under applicable law, including fraud or personal injury caused by negligence.

10. Termination

Either party may withdraw from an engagement with reasonable written notice. If we withdraw, we will provide written outputs for the work completed to that point and, where appropriate, a partial refund.

Terms relating to confidentiality, intellectual property, and limitation of liability continue to apply after the conclusion or termination of an engagement.

11. Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising in connection with these terms or our services shall first be referred to informal discussion between the parties, with a view to reaching a reasonable resolution.

If informal resolution is not possible, disputes shall be subject to the jurisdiction of the courts of Malaysia. Nothing in this clause prevents either party from seeking urgent equitable relief where appropriate.

12. General Provisions

13. Changes to These Terms

We may update these terms from time to time. The revised version will be published on this page with an updated effective date. Continued use of our website or services after a revision constitutes acceptance of the updated terms. For active engagements, material changes will be communicated directly.
